3. Legal Basis for Processing (POPIA & GDPR)

We process your personal information based on the following lawful grounds: (a) Contract performance — processing necessary to deliver the services you have subscribed to; (b) Legitimate interests — improving our Platform and preventing fraud; (c) Legal obligation — complying with applicable laws and regulations; and (d) Consent — for marketing communications and non-essential cookies, which you may withdraw at any time by contacting us.

4. Data Sharing and Third Parties

We do not sell your personal information. We may share your data with trusted third-party service providers who assist us in operating the Platform, subject to strict confidentiality agreements:

  • Stripe — payment processing (subject to Stripe's Privacy Policy)
  • Cloud hosting providers — secure data storage and infrastructure
  • Email service providers — transactional and notification emails
  • Analytics providers — anonymised usage analytics

We may also disclose your information if required by law, court order, or governmental authority, or to protect the rights, property, or safety of Global Trade Hub, our users, or the public.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide services. After account deletion, we retain data for a maximum of 3 years to comply with legal and tax obligations, after which it is securely deleted. Anonymised, aggregated data may be retained indefinitely for analytical purposes.

6. Your Rights Under POPIA

As a data subject under POPIA (and GDPR for EU users), you have the following rights:

  • Right of access — request a copy of the personal information we hold about you
  • Right to rectification — request correction of inaccurate or incomplete data
  • Right to erasure — request deletion of your personal data (subject to legal retention requirements)
  • Right to object — object to processing based on legitimate interests or for direct marketing
  • Right to data portability — receive your data in a structured, machine-readable format
  • Right to lodge a complaint — with the Information Regulator of South Africa at inforegulator.org.za

We use essential session cookies to maintain your login state and provide core Platform functionality. We do not use tracking cookies or third-party advertising cookies without your explicit consent. You can control cookie settings through your browser settings.

9. International Data Transfers

Your data may be processed in countries outside South Africa where our service providers operate. We ensure that any international transfers comply with POPIA's cross-border transfer requirements and that adequate protection is in place through contractual safeguards.

10. Children's Privacy

The Platform is intended for business use by adults aged 18 and over. We do not knowingly collect personal information from children under 18. If you believe we have inadvertently collected such information, please contact us immediately and we will delete it.
